dc.description.abstractThis document outlines the ACL 121 Commercial Law Degree Supplementary Examination from October/November 2024 at the University of Fort Hare. The exam is 3 hours long and worth 100 marks, divided into two sections. Section A comprises multiple-choice questions covering various aspects of commercial law, including statutory interpretation, contracts of sale, leases, credit agreements, unsolicited goods, agency, electronic commerce, insolvency, testate succession, mortgage bonds, collective agreements, arbitration, insurance, and insider trading. Section B consists of short answer questions that require detailed explanations on topics such as presumptions in legal interpretation, perfection of a contract of sale, clauses in second-hand goods contracts, the principle of huur gaat voor koop, duties of a lessor, consumer rights under the National Consumer Act, application of the Consumer Protection Act to gift vouchers, distinguishing between mandate and agency, requirements for electronic signatures, removal of a trustee, inheritance in cases of unlawful killing, requirements for a valid mortgage bond, permissible reasons for dismissal, reversal of arbitration awards, and termination of a trust.
