    State funded social assistance to refugee children: defining a constitutional standard for child refugee protection in South Africa

    The problem that this mini-dissertation addresses is whether or not the South African Constitution and legislation extends social assistance rights to refugee children. This study argues that a teleological and purposive interpretation of the Constitution would ensure access by refugee children to social assistance. The main objective of this study is not only to ascertain if the South African Constitution and legislation entrenches the right to social assistance to refugee children but also to assess if there is congruence between the level of protection agreed to at the international level and that implemented at the national level. The findings are meant to alert and assist the government on the policy and legislative deficit in the protection of refugee children, and therefore, enable it to offer better protection in line with its constitutional standards and international obligations.
