This study argues that a teleological and purposive interpretation of the Constitution would ensure access by refugee children to social assistance. The main objective of this study is not only to ascertain if the South African Constitution and legislation entrenches the right to social assistance to refugee children but also to assess if there is congruence between the level of protection agreed to at the international level and that implemented at the national level.
